Cannabis Dispensary Insurance in New York
Last updated October 18, 2026. Licensed in Florida and New York.
What insurance does a New York dispensary need?
We have not found a published numeric insurance minimum for adult-use dispensaries, so be cautious with anyone who quotes an "OCM minimum limit." Employers must carry workers' compensation, and New York also requires disability (DBL) and Paid Family Leave (PFL) coverage. CAURD licensees must indemnify and hold the State of New York harmless against civil and criminal penalties tied to the license. Your lease and lender usually set the practical limits for general liability, product liability, property, cyber and crime. The $2M surety bond often mentioned for New York applies to medical Registered Organizations, not to ordinary adult-use dispensaries.
Coverage a New York dispensary runs on
General Liability
Premises liability for customers. Leases commonly specify the limit (often $1M/$2M), additional insured status for the landlord, and waiver wording. Get the lease insurance exhibit before you bind coverage.
Product Liability
Selling state-approved product does not end your exposure. Contamination, labeling and recall claims can reach the retailer. Pricing depends on product mix and volume.
Workers' Compensation and DBL/PFL
Workers' comp is required for employers. DBL and PFL are separate statutory coverages that new retailers sometimes miss until a payroll audit. We set up both together.
Commercial Property
Build-out, security systems, safes and inventory. Fire, water and theft are the main loss drivers. Pricing depends on insurable values and loss controls.
Crime / Employee Dishonesty
Dispensaries handle a lot of cash. Crime coverage is the usual companion to property, and many landlords and lenders ask for it.
Cyber Liability
POS data, customer records and state tracking-system credentials. A breach at a regulated business is a compliance matter as well as an IT problem.
Commercial Auto
If you deliver or transfer product, commercial auto and cargo coverage apply. Delivery coverage is priced separately from in-store retail. See our New York cannabis delivery insurance page.
New York specifics most brokers miss
- CAURD vs. general retail. CAURD licenses carry the state indemnification condition. Standard retail licenses are shaped more by lease and lender terms. Either way, the landlord's insurance exhibit decides your limits, so we quote against it. See our CAURD dispensary page.
- The $2M bond is not an adult-use retail requirement. It applies to medical Registered Organizations.
- NYC premises are underwritten individually. Building age, sprinkler status, neighboring tenants and security plans affect property and liability pricing.
- Timing. Certificates are often requested at lease signing, during build-out and at license milestones, not only at opening. Starting insurance at the lease stage avoids last-minute placements.

Frequently asked questions
Does the OCM require specific insurance limits for dispensaries?
We have not found a published numeric insurance minimum for adult-use dispensary licenses. Employers must carry workers' compensation and DBL/PFL coverage. CAURD licensees must indemnify and hold the State of New York harmless against civil and criminal penalties tied to the license. Your lease and lender usually set the practical limits. If someone quotes you an "OCM-required limit," ask for the citation.
Do New York dispensaries need a $2 million bond?
The $2 million surety bond requirement applies to medical Registered Organizations. It does not apply to ordinary adult-use retail dispensaries.
When should I buy dispensary insurance, before or after the lease?
Before you sign. The lease insurance exhibit sets limits and endorsements, and certificates are often requested at signing, during build-out and at opening. Quoting against the actual lease avoids buying limits you do not need or finding a gap late.
Can you insure a dispensary that is not open yet?
Yes. Coverage can be placed for licensees in build-out, starting with builders risk or property during construction and moving to the full retail program at opening. Tell us your license stage and we will sequence it.
Do you work in Spanish?
Yes. We work in English, Spanish and Portuguese, including certificates and lease exhibits.
